1. ACCEPTANCE OF THE TERMS

By creating an account, accessing the PAQPAQ platform or using our services, you fully accept these Terms and Conditions, as well as our Privacy Notice. If you do not agree with any of these terms, we recommend that you do not use the service. Continued use of the platform constitutes acceptance of these terms in their most recent version.

 

2. DESCRIPTION OF THE SERVICE

PAQPAQ is a technology platform (SaaS) that allows shippers in Mexico to:

  • Quote and generate shipping labels with multiple carriers through our partner providers (Skydropx and other authorized logistics operators).
  • Issue Digital Tax Receipts via Internet (CFDI 4.0) with Carta Porte in accordance with the provisions of the Tax Administration Service (SAT).
  • Integrate e-commerce stores (Shopify, Tiendanube, WooCommerce, among others) to automate fulfillment processes.
  • Schedule package pickups and track shipments in real time.

 

3. REGISTRATION AND USER ACCOUNT

To use PAQPAQ's services you must:

  • Register and provide truthful, accurate, complete and current information.
  • Be over 18 years old and have the legal capacity to enter into contracts.
  • Provide a valid RFC tax ID in accordance with SAT provisions.
  • Provide a current email address and phone number.

You are responsible for keeping your password and access credentials confidential. It is your obligation to notify PAQPAQ immediately if you detect any unauthorized access to your account. PAQPAQ is not liable for damages caused by unauthorized use of your account resulting from your negligence in keeping your access credentials confidential.

 

4. PAYMENTS, BALANCE AND TOP-UPS

PAQPAQ's service operates on a prepaid balance system:

  • You must keep a sufficient balance in your account in order to generate shipping labels.
  • The cost of each shipment is deducted from your balance at the moment the label is generated.
  • Balance top-ups are processed through Stripe or other authorized payment methods.
  • Balance top-ups are final and non-refundable, except in the event of a technical error directly attributable to PAQPAQ.

For refunds due to technical errors, you must report the issue within 30 calendar days of the date of the error. PAQPAQ will investigate and resolve it in accordance with its internal procedures.

 

5. CANCELLATIONS, REFUNDS AND LABEL POLICIES

Automatic label cancellation:

When a shipment is not handed over to the carrier within the period established by each logistics operator (typically 24-48 hours), the corresponding balance is automatically credited back to your account. This refund is issued without any additional procedure.

Labels in transit:

Once the label has been handed over to the carrier and enters in-transit status, the cancellation and refund policies of each logistics operator apply, not those of PAQPAQ. You must check directly with the corresponding carrier.

Claims on paid labels:

Claims regarding lost, damaged or delayed shipments must be directed to the responsible carrier, in accordance with their terms of service. PAQPAQ acts as an intermediary and assumes no direct liability for events attributable to third parties (logistics operators).

 

6. ACCEPTABLE USE OF THE PLATFORM

It is prohibited to use PAQPAQ to:

  • Ship prohibited, restricted or controlled goods under Mexican law or the policies of partner carriers.
  • Carry out fraudulent, deceptive or unlawful activities.
  • Impersonate third parties or use falsified personal data.
  • Attempt to reverse engineer, decompile or gain unauthorized access to PAQPAQ's code or infrastructure.
  • Carry out denial-of-service (DDoS) attacks, code injection or exploitation of vulnerabilities.
  • Generate abnormal volumes of traffic or queries that affect the operation of the service.
  • Breach PROFECO (Federal Consumer Protection Agency) rules or consumer protection regulations.

Failure to comply with these restrictions may result in immediate suspension of your account, loss of unused balance and additional legal action in accordance with the law.

 

7. USER RESPONSIBILITIES

You are responsible for:

  • Verifying that the shipping details (weight, dimensions, address, contents) are accurate and complete.
  • Checking each carrier's official channels to confirm whether the goods have transport restrictions.
  • Providing truthful information in CFDI and Carta Porte in accordance with SAT provisions.
  • Complying with customs regulations if the shipment is international.
  • Packing the product properly to avoid damage during transit.

For discrepancies between declared weight or volume and actual weight/volume, the user accepts that additional charges may be applied for overweight or surcharges, in accordance with the corresponding carrier's rate.

 

8. PERSONAL DATA PROTECTION (LFPDPPP)

PAQPAQ is the controller responsible for processing personal data in accordance with the Federal Law on Protection of Personal Data Held by Private Parties (Ley Federal de Protección de Datos Personales en Posesión de los Particulares, "LFPDPPP"), in force as of 2025.

Data collected:

Name, email address, phone number, RFC tax ID, business address, billing data and recipients' shipping data (name, phone number, address).

Purposes of processing:

  • Providing label generation and CFDI services.
  • Complying with tax and legal obligations before the SAT, Customs and competent authorities.
  • Preventing fraud and unlawful activities.
  • Improving our services through aggregate (not individual) analysis.
  • Commercial communications (only if you have consented).

ARCO rights:

Under the LFPDPPP, you have the right to Access, Rectify, Cancel or Object to the processing of your data. To exercise these rights, write to hola@paqpaq.mx with a copy of official identification.

Data sharing:

Your data is shared with partner carriers (Skydropx, FedEx, UPS, DHL, Estafeta, etc.) solely for delivery purposes. It is also shared with tax authorities (SAT) in accordance with legal obligations. See our full Privacy Notice for more details.

 

9. INTELLECTUAL PROPERTY

The PAQPAQ brand, software, source code, databases, documentation, design and platform content are the property of Aranzazu Gamboa Andrade (an individual with business activity, PAQPAQ) and are protected by:

  • The Federal Copyright Law (Ley Federal de Derechos de Autor).
  • The Industrial Property Law of Mexico (Ley de Propiedad Industrial).
  • International intellectual property conventions.

You are granted a limited, non-exclusive and revocable license to use the platform in accordance with these terms. Any other use requires prior written permission.

 

10. LIMITATION OF LIABILITY

PAQPAQ acts as a technological intermediary between you and the logistics operators. Our responsibilities and limitations are as follows:

Carrier liability:

PAQPAQ is not liable for delays, losses, damage, theft, misplacement or any event that occurs while packages are in transit. These liabilities belong to the carriers. You must file claims directly with the corresponding carrier in accordance with their terms of service.

Information errors:

PAQPAQ is not liable for errors made by the user when entering shipping data. You must verify that the information is correct before confirming the label.

Service availability:

PAQPAQ strives to maintain 99.5% platform availability. It is not liable for unavailability due to maintenance, updates, force majeure events, cyberattacks or carrier downtime.

Maximum liability cap:

PAQPAQ's maximum liability towards you is limited to the total amount paid to PAQPAQ during the 3 months prior to the event giving rise to the claim. Under no circumstances will PAQPAQ be liable for indirect damages, loss of profits, moral damages or loss of business opportunity.

 

11. ACCOUNT SUSPENSION AND TERMINATION

Termination by the user:

You may close your account at any time from the "Settings > Privacy" section or by writing to hola@paqpaq.mx. After cancellation, your unused balance will not be refunded, except as provided by the Federal Consumer Protection Law.

Termination by PAQPAQ:

PAQPAQ may suspend or terminate your account immediately if you:

  • Breach these Terms and Conditions.
  • Use the platform for unlawful or prohibited activities.
  • Maintain a negative balance for more than 30 days.
  • Engage in fraud, impersonation or malicious activities.
  • Violate data protection or privacy rules.

In the event of suspension, PAQPAQ will notify you by email. You will have 15 days to remedy the breach and request reactivation.

 

12. MODIFICATIONS TO THESE TERMS

PAQPAQ may update these Terms at any time. Material changes (affecting rights or obligations) will be notified by email at least 15 days in advance. Your continued use of the platform after the notice period constitutes acceptance of the modified terms.

 

13. COMPLIANCE WITH MEXICAN LAW

PAQPAQ complies with the following Mexican legal provisions:

  • Federal Consumer Protection Law (LFPC): transparency in pricing, terms and customer service.
  • Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP): data protection and processing in accordance with ARCO rights.
  • Federal Economic Competition Law (LFCE): lawful competitive practices without unjustified discrimination.
  • Income Tax Law (LISR): compliance with tax obligations as an individual with business activity.
  • Federal Copyright Law: protection of the platform's content and software.
  • Official Mexican Standards (NOM) applicable to e-commerce and logistics services.

 

14. DISPUTE RESOLUTION

Amicable procedure:

Every dispute will first be addressed amicably through direct negotiation. Write to hola@paqpaq.mx with a detailed description of the problem. We will respond within 10 business days.

Conciliation:

If no agreement is reached, you may request conciliation before PROFECO (Federal Consumer Protection Agency) free of charge, in accordance with the LFPC.

Arbitration and jurisdiction:

These Terms are governed by the laws of the United Mexican States. The parties submit to the jurisdiction of the competent courts of Mexico City, in accordance with the Federal Tax Code (Código Fiscal de la Federación) and the Code of Civil Procedure (Código de Procedimientos Civiles), expressly waiving any other jurisdiction or venue.

 

15. GENERAL PROVISIONS

Partial invalidity:

If any clause is declared void, unlawful or unenforceable, the remaining clauses remain in force. An interpretation will be sought that upholds the greatest possible number of provisions.

Relationship between the parties:

You and PAQPAQ are not employees, partners or agents of one another. You are not authorized to legally bind PAQPAQ without prior written consent.

Entire agreement:

These Terms, together with the Privacy Notice, constitute the entire agreement between the parties regarding PAQPAQ. Any prior verbal negotiations or emails are superseded.
